Terms & Conditions

These Terms & Conditions are between you and Kylie's Creatures LLC, a West Virginia limited liability company ("Kylie's Creatures," "we," "us"). By creating an account or continuing to use Kylie's Creatures Club (the "Service"), you agree to these Terms. If you do not agree, please do not use the Service.

The Service is an online, faith-based animal education membership for families, including Creature Files lessons, printable worksheets, educational games, and related content.

Accounts are created and managed by a parent or legal guardian who is at least 18 years old. By creating an account, you confirm that you are an adult and that you have the authority to agree to these Terms on behalf of your household. Children use the Service under a parent's supervision.

You are responsible for keeping your account credentials confidential and for all activity that happens under your account. Please provide accurate information and keep it up to date.

You agree not to misuse the Service. That means you will not:

• Use the Service for anything unlawful, fraudulent, or deceptive;
• Send spam or use the Service to harass or harm others;
• Copy, redistribute, resell, or publicly share our lessons, worksheets, videos, or other content without permission;
• Infringe anyone's intellectual property rights;
• Probe, scan, or test the security of the Service, introduce malware, scrape content, or interfere with how the Service works;
• Reverse engineer the Service or attempt to circumvent technical limits, including access controls.

Kylie's Creatures LLC owns the Service and all of its content — including software, lessons, videos, worksheets, games, documentation, and branding — and retains all intellectual property rights.

We grant you a limited, non-exclusive, non-transferable right to use the Service for your family's personal, non-commercial use, within the plan you have selected. Printable materials may be printed for use within your own household. You may not resell, redistribute, or republish any part of the Service.

If you send us questions, messages, or other content (for example through our contact or "Ask Kylie" forms), you give us a limited license to host and process that content solely to operate and improve the Service and to respond to you. You are responsible for the content you submit and for having the right to share it.

Paid memberships are billed as a subscription (monthly or yearly, as selected at checkout) and renew automatically until cancelled. You can cancel at any time; cancellation takes effect at the end of the current paid period.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms, available at https://www.paddle.com/legal/checkout-buyer-terms. Please also see our Refund Policy.

We work hard to keep the Service available, but we do not guarantee that it will be uninterrupted, timely, secure, or error-free. We may update, change, or discontinue parts of the Service from time to time.

We may suspend or terminate access to the Service if you materially breach these Terms, if payment is not made, if we reasonably suspect fraud or a security risk, or for repeated or serious violations of these Terms. When access ends, your right to use the Service ends. Family profiles, progress, and badges are retained so they can be restored if the account is reactivated, unless you ask us to delete your data.

The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all implied warranties, including warranties of merchantability and fitness for a particular purpose. Educational content is provided for general learning and enjoyment.

To the fullest extent permitted by law, Kylie's Creatures LLC will not be liable for indirect, incidental, consequential, or special damages (including loss of profits, data, or goodwill) arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim. Nothing in these Terms excludes liability for fraud, death, or personal injury where the law does not allow it.

You agree to indemnify and hold harmless Kylie's Creatures LLC from claims arising out of content you submit, your unlawful use of the Service, or your violation of these Terms.

These Terms are governed by the laws of the State of West Virginia, without regard to conflict of laws rules. Any dispute will be resolved in the state or federal courts located in West Virginia, and you consent to their jurisdiction.

You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets. We are not responsible for delays or failures caused by events beyond our reasonable control. If any part of these Terms is found unenforceable, the rest remains in effect.

We may update these Terms from time to time. Continued use of the Service after changes means you accept the updated Terms.
